Terms and Conditions of Sale


The buyer acknowledges that they are fully aware that their agreement to the content of these general terms and conditions does not require a handwritten signature on this document when ordering online products presented in the website store. The buyer has the option, under their sole responsibility, to save or edit these general terms and conditions, which are subject to change.
In this case, the applicable conditions will be those in effect on the website on the date the order is confirmed.
All of this information is presented in French. The buyer declares and acknowledges that they have full legal capacity to enter into a binding agreement with these general terms and conditions.

1 – Entire Agreement

These general terms and conditions express the entire rights and obligations of the parties.
The buyer is deemed to accept without reservation all the provisions set forth in these general terms and conditions of sale, and SABAROT WASSNER S.A.S. undertakes to fulfill its role as reseller within the framework of said terms and conditions.

2 – Purpose

The purpose of these general terms and conditions is to define the rights and obligations of the parties in the online sale of goods and services offered by SABAROT WASSNER S.A.S. to the buyer.

3 - Contractual Documents

This contract is comprised of the following contractual documents, presented in descending hierarchical order:

- The purchase order

In the event of any contradiction between the provisions contained in these documents, the provisions of the general terms and conditions of sale shall prevail. 4 - Effective Date

- Duration: These general terms and conditions come into effect on the date the purchase order is validated.

These general terms and conditions are entered into for the duration necessary to provide the goods and services purchased, until the expiration of the warranties.

5 - Order Validation and Electronic Signature (Law of March 13, 2000 on Electronic Signatures)

Any purchase order signed by the buyer by "double-clicking" constitutes irrevocable acceptance that may only be challenged within the limits provided below in these general terms and conditions of sale, in particular "right of withdrawal" and "out of stock".

The "double-click" associated with the authentication and non-repudiation procedure and the protection of message integrity constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.

6 - Order Confirmation

Contractual information will be confirmed by email.

Some orders require verification by our verification department. In this case, you will be notified by email of the supporting documents required to obtain final validation of your order. SABAROT WASSNER S.A.S reserves the right to cancel the order if these supporting documents are not received or if documents deemed non-compliant are received.

Any order paid by bank transfer will only be processed upon receipt of payment. Availability and shipping times are recalculated from the date of receipt of the payment method.

SABAROT WASSNER S.A.S recommends that the buyer keep a record of the order data on paper or on a reliable electronic medium. The buyer must verify the completeness and accuracy of the information provided to SABAROT WASSNER S.A.S.

The latter cannot be held responsible for any data entry errors or the consequences in terms of delays or incorrect deliveries. In this context, all costs incurred for reshipping will be borne by the buyer.

7 - Proof of Transaction

The computerized records, stored in the computer systems of SABAROT WASSNER S.A.S. under reasonable security conditions, will be considered proof of communications, orders, and payments between the parties. Purchase orders and invoices are archived on a reliable and durable medium that can be produced as evidence.

8 - Product Information

- SABAROT WASSNER S.A.S. presents the products for sale on its website with the necessary characteristics, as communicated to it by suppliers, in compliance with Article L. 111-1 of the French Consumer Code, which provides for the possibility for potential buyers to know the essential characteristics of the products they wish to purchase before placing a final order.

- The offers presented by SABAROT WASSNER S.A.S. are only valid while stocks last.

- The total or partial inability to use the products, particularly due to hardware incompatibility, shall not give rise to any compensation, refund, or liability on the part of SABAROT WASSNER S.A.S., as the buyer remains the sole judge of the compatibility of the products ordered with those already in their possession.

- SABAROT WASSNER S.A.S. guarantees the Buyer against hidden defects that may affect the delivered products, by replacing defective products or parts rendering them unfit for use, or by refunding them, without being held liable by the Buyer for any harmful consequences that these hidden defects may have caused under certain conditions.

- SABAROT WASSNER S.A.S. is subject to the principle of Extended Producer Responsibility and has a unique identifier, which is proof that the company adheres to a waste management system, in accordance with the provisions of the Anti-Waste for a Circular Economy Act. The unique identifier number of SABAROT WASSNER S.A.S. is: FR211394_01UOCS. Its suppliers are also subject to the principle of Extended Producer Responsibility; their unique identifier numbers are: FR215 138_01YTAP.

9 – Prices

Prices are indicated in Euros and are only applicable on the date the buyer sends the order confirmation. They do not include delivery costs, which may be charged in addition and are indicated before the final confirmation of the order.

Any shipping costs requested from the buyer are clearly stated on the PRO.SABAROT.COM website.

Prices include the VAT applicable on the date of the order, and any change in the statutory VAT rate will be automatically reflected in the price of the products presented on the website, on the date stipulated by the implementing decree.

Full payment must be made at the time of ordering, unless otherwise specifically stated on the website. At no time may the amounts paid be considered a deposit or down payment.10 - Payment Method

To pay for their order, the buyer may choose from all the payment methods listed on the order form: credit card and bank transfer.

Availability and shipping times will be recalculated from the date the payment method is received.

Payments by credit card are collected upon confirmation of the order. The buyer guarantees SABAROT WASSNER S.A.S. that they have the necessary authorizations to use the payment method chosen by them when confirming the order form. SABAROT WASSNER S.A.S. reserves the right to suspend any order processing and delivery in the event of refusal of authorization for payment by credit card or bank transfer by officially accredited organizations or in the event of non-payment.

SABAROT WASSNER S.A.S. reserves the right to refuse to make a delivery or honor an order from a buyer who has not fully or partially paid for a previous order or with whom a payment dispute is pending.

SABAROT WASSNER S.A.S. retains full ownership of the products sold until full payment of all amounts owed by the buyer in connection with their order, including fees and taxes. SABAROT WASSNER S.A.S. will not be responsible for transferring ownership of a product purchased from SABAROT WASSNER S.A.S. by the buyer to a third party. Only the original purchaser of the product may invoke the provisions of these general terms and conditions of sale.

11 - Disputes

In the event of a dispute, the buyer is informed that they may, in any event, resort to conventional mediation.

The buyer may use the mediation service for consumer disputes related to an order placed on the PRO.SABAROT.COM website.

Before resorting to mediation and contacting the competent mediator, the buyer must have attempted to resolve their dispute with the professional amicably. Only in the event of failure or an unsuccessful complaint may the mediator be contacted.

After the buyer has submitted a prior written declaration of dispute to SABAROT WASSNER S.A.S. Customer Service (2, rue des Perdrix - Z.I. La Combe - 43320 Chaspuzac - France), if the consumer dispute cannot be resolved, the mediator may be contacted.

The mediator must be contacted within a maximum of one year from the initial complaint.

SABAROT WASSNER S.A.S. is a member of the CNPM (National Chamber of Mediation Practitioners) service.
