PRODUCT DELIVERY AND AVAILABILITY TIMES

Sabarot-Wassner undertakes to deliver or make available to the buyer the ordered products within the maximum delivery time specified for each product and indicated on the website, namely within a maximum of fifteen (15) business days from the order confirmation.
In the event of an order for products that can be delivered or are available on different dates, given their availability, the delivery and availability time will be based on the longest delivery time.
In the event of a delay, the buyer may cancel their order by sending an email to the following address: "shop-pro@sabarot.com". In this case, if the buyer receives it after their cancellation request, they must refuse it by stating "refused due to cancellation delay."
If applicable, Sabarot-Wassner will refund the product and return shipping costs as quickly as possible, and no later than thirty (30) days after the order was placed, upon receipt of the product in the case of delivery and upon receipt of the cancellation request in the case of availability.
If the delivery delay is caused by a case of force majeure as defined by the case law of the French courts, Sabarot-Wassner will inform the buyer by email that their cancellation request cannot be granted.
DELIVERY CONDITIONS

Delivery is effected by delivery of the products to the agreed place.
The recipient must inspect the goods upon delivery. This inspection must include, in particular, the quality, quantities, and references of the goods, as well as their conformity with the order.
If damage or missing items are noted, the Customer must make specific and complete reservations on the transport document and reiterate their protest, providing reasons, clearly, precisely, and completely, in the forms and within the time limits provided for in Article 133-3 of the French Commercial Code.
In the event of damage occurring during transport, it is the Customer's responsibility to exercise any recourse against the carrier; claims must be made upon delivery.
No claim will be considered if the required reservations have not been made to the carrier on the delivery note and consignment note, confirmed by registered letter with acknowledgment of receipt within three (3) days, in accordance with Article L.133-3 of the French Commercial Code.
DELIVERY RATES (delivery within the European Union only, excluding overseas territories):

Delivery costs are indicated to the customer as they select their products and are billed at the end of the order in addition to the price of the selected products. The delivery cost is visible in the shopping cart and is summarized during the checkout process. Delivery costs are generally the responsibility of the customer. The following delivery costs are exclusive of tax and apply per order to the same customer for all orders of at least €75 excluding VAT.
- Local customers*: Free delivery.

- Customers in mainland France: For all orders of €150 or less, a €30 shipping fee will apply.
- Customers in mainland France: For all orders over €150, shipping will be free.
- Zone 1 customers**: For all orders of €300 or less, a €50 shipping fee will apply.
- Zone 1 customers**: For all orders over €500, shipping will be free.
- Zone 2*** customers: for all orders of €500 or less, a €100 shipping charge will apply.
- Zone 2*** customers: for all orders over €500, delivery will be free.

RESERVE

Without prejudice to the buyer's right of withdrawal for certain products, it is the buyer's responsibility to check the apparent condition of the products upon delivery.
In case of doubt, the buyer is advised to open the package in the presence of the carrier to ensure there is no damage to the products. In the event of an anomaly (damage, products missing from the delivery note, damaged packages, opened or broken products, delivery error, etc.), the buyer must make any reservations and complaints that appear justified on the delivery note presented by the carrier, in a handwritten and detailed manner, or even refuse delivery.
These reservations must be confirmed by email to the following address: shop-pro@sabarot.com within forty-eight (48) business hours following delivery of the products. The buyer must give Sabarot every opportunity to identify these non-conformities and remedy them. The customer shall refrain from intervening themselves or involving a third party for this purpose. Failing this, any claim will be automatically rejected.

RIGHT OF WITHDRAWAL

In accordance with Article L.121-20 of the French Consumer Code, the customer has 14 clear days from the date of receipt of the goods to return the products in their original packaging, intact, unopened, and unused. When the fifteen-day period expires on a Sunday, public holiday, or bank holiday, it is extended until the next business day. The right of withdrawal may be exercised by the customer without having to provide a reason or pay any penalties, with the exception of any return shipping costs. The right of withdrawal does not apply to perishable food products, which, by their nature, are likely to deteriorate or expire quickly. The customer has the option to either return the products to Sabarot or ship them at their own expense to the company's address (2, rue des Perdrix - Z.I. La Combe - 43320 Chaspuzac - France). The customer must specify whether they would like to exchange or receive a refund.
If an exchange is requested, the customer is invited to come directly to Sabarot to collect the exchanged product within three days of the exchange request. If the exchanged product has a higher retail value than the product originally ordered, the customer will be asked to pay the difference to the store. If the exchanged product has a lower retail value than the product originally ordered, the store will refund the difference to the customer.
If a refund is requested, it will be issued by the store as soon as possible and no later than thirty days following the date on which the customer exercised their right of withdrawal. At Sabarot's suggestion, the customer may also opt for another reimbursement method such as the granting of a credit on a future order.

SELLER'S RESPONSIBILITIES - WARRANTIES

SABAROT shall not be held liable if the products sold are used or stored in abnormal conditions or conditions incompatible with their nature.
In any event, neither party shall bear any financial liability other than the direct consequences of its liability within the limits of the guarantees provided by its insurance company, with the exception of any commercial damages or loss of profits or image. It is further expressly agreed between the parties that the Seller, SABAROT, accepts that neither Party shall be liable under any circumstances for indirect or consequential damages (such as, but not limited to, financial damages, commercial losses, damage to image, loss of profits, etc.) and that no right to compensation may be claimed. Products must be inspected by the customer upon delivery, and any claims, reservations, or disputes regarding apparent shortages, damage, or non-conformities must be made under the conditions set out in Article 4.
Defects and deterioration of delivered products resulting from abnormal storage and/or preservation conditions at the customer's premises, particularly in the event of an accident of any kind, will not give rise to the warranty provided by our company. Under the warranty against hidden defects, our company will only be liable for the replacement of defective goods free of charge, without the customer being entitled to claim damages for any reason whatsoever.
RETURNS

In the event of a shortage, damage, apparent defect, or lack of conformity of the delivered products entirely attributable to the seller, the latter undertakes to refund the price of the products paid or to replace them at its expense as soon as possible. This remedy excludes any other remedy such as a claim for penalties, price reduction, or damages. In the event of a hidden defect, claims will be subject to compliance with the legal conditions of the French Civil Code applicable to the warranty against hidden defects. However, professional customers must send their complaint to SABAROT WASSNER by email (shop-pro@sabarot.com) within a maximum of two business days from the discovery of the defect. Beyond this period, no claims will be accepted. Furthermore, the remedy owed to the professional customer is limited to the replacement of the products or the cancellation of the order, excluding any damages or price reduction.
